Welcome to Raiise, a digital e-learning resource promoting gender equality and respect in schools and sports clubs. By accessing or using our services, you agree to comply with and be bound by these Terms of Use. Please read these Terms of Use carefully. Raiise is supplied to you by Raiise Pty Ltd (ACN 678 651 075 ) (“us”, “we”) and you and we agree to these Terms of Use.

  1. Acceptance of Terms

    By accessing and using Raiise, you agree to these Terms of Use and any additional terms and conditions that are referenced herein or that otherwise may apply to specific sections of Raiise. If you do not agree with these Terms of Use, you should not use our services.

  2. Changes to Terms

    We reserve the right to modify or update these Terms of Use at any time without prior notice. We will send you notice of changes to these Terms of Use. If you do not agree to the changes you may terminate your subscription by providing us 7 days written notice and we will refund the subscription fee to the extent that it is applicable to any subscription period following termination. Otherwise your continued use of our services after any changes have been made signifies your acceptance of the modified or updated Terms of Use.

  3. Access and Use of Services

    • Eligibility: Our services are intended for use by schools and sports clubs. Individuals must be authorised representatives of their respective organisation to access and use Raiise. Each person who uses Raiise does so for and on behalf of its organisation and may not access or use Raiise in its personal or any other capacity.
    • Account Registration: Users must register for an account to access certain features. All information provided must be accurate, current, and complete. You are responsible for keeping any user name and password we issue to you secure and are responsible for all use and activity carried out under that user name.
    • Payment: Access to Raiise is subscription-based. Payment must be made in accordance with the terms set forth at the time of purchase. We reserve the right to change subscription fees at any time. If you do not agree to any such change, you must cease use of Raiise at the end of last subscription period for which you have paid the subscription fee. We will use reasonable endeavours to provide you a reasonable period of notice of any such change.
    • License: Upon payment, we grant you a limited, non-exclusive, non-transferable license to access and use the digital resources solely for educational purposes within your organisation. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, commercially exploit, create derivative works from, transfer, or sell any content, software, products or services contained within Raiise. You may not use Raiise to further any commercial purpose.

  4. User Conduct

    1. Prohibited Uses: You agree not to use Raiise for any unlawful purpose or in any way that could harm the services or impair anyone else’s use of Raiise.
    2. Content: You are responsible for any content you upload or share through Raiise. Content must not infringe the intellectual property rights of others or violate any laws.
    3. Respect and Equality: All interactions on Raiise should promote gender equality and respect. You agree not to engage in harassment, discrimination, or any form of abuse.

  5. Intellectual Property

    All content, trademarks, and data on Raiise, including but not limited to software, databases, text, graphics, icons, and hyperlinks, are the property of Raiise or its licensors. Unauthorised use, reproduction or copying is prohibited.

  6. Privacy

    Your use of Raiise is also governed by our Privacy Policy, which outlines how we collect, use, and protect your information. Our Privacy Policy is available here: https://education.raiise.com.au/privacy-policy. You agree to the terms of our Privacy Policy.

  7. Termination

    We reserve the right to terminate or suspend your access to the services, without prior notice, for conduct that violates these Terms of Use or is harmful to other users.

  8. Disclaimer of Warranties

    To the fullest extent permitted by law, Raiise is provided “as is” and “as available” and we make no warranties of any kind. We do not guarantee that our services will be uninterrupted or error-free.We do not guarantee Raiise will continue to be available for any period longer than the subscription period for which you pay the subscription fee.

  9. Limitation of Liability

    To the fullest extent permitted by law, neither party shall be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from a breach of these Terms of Use or your use of our services.

    To the fullest extent permitted by law, our liability to you for breach of any consumer guarantee under the Australian Consumer Law applicable to supply of services to you is limited to, at our option:

    1. the supplying of the services again; or
    2. the payment of the cost of having the services supplied again.

  10. Governing Law

    These Terms of Use are governed by and construed in accordance with the laws of South Australia. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of South Australia.

By using Raiise, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use.

Intellectual Property Agreement

The Raiise Respect Schools Porgram (“the Program”) has been created, developed by Raiise Pty Ltd.
 
The purpose of this agreement is to set out certain conditions (“the Terms”) for educators delivering the Raiise program to their schools and sports clubs.
 
The Program consists of several assets including but not limited to; interactive online activities, lesson plans, videos and activities (“Intellectual Property”). All Program materials are subject to copyright and may not without the written permission from Raiise Pty Ltd be copied, distributed, or shared unless in direct connection with the delivery of the complete program by a facilitator that hias signed up for the program at a participating school or sporting organisation. No part may be used outside of the program. For example, activities may not be undertaken unless part of the delivery of the Program. These activities are not permitted to be distributed to others not facilitating or participating in the program outside of the school community. This includes all program materials, such as interactive online activities, lesson plans, videos, and activities.
 
Facilitators delivering the program must ensure that all Intellectual Property is protected and not shared with any party other than students undertaking the program.
